Little Tales Co. — Terms of Service

1. About these terms

These terms are an agreement between you and Tomas Draper, trading as Little Tales Co. (ABN 78 443 483 135) ("we", "us") covering your use of the Little Tales Co. app and website at https://littletalesco.com (the "Service").

By creating an account, subscribing, or using the Service, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Who can use the Service

You must be 18 or over, and you must be a parent, carer, guardian, or the person with authority to record and share the stories you create. Accounts are personal to you — one person may hold several roles (for example a parent in their own family and a reader invited into another), but an account is not to be shared.

3. What the Service does

The Service is for personal, family use. It is not a backup service: do not rely on it as the only copy of anything irreplaceable.

4. Your account and your responsibilities

You agree to give accurate details, keep your password secure, tell us promptly if you think someone else has access to your account, and use the Service lawfully.

Recording other people. You are responsible for having the consent of every person whose voice you record, or another lawful basis to record them. Where a recording includes a child, you confirm you are their parent, carer or guardian, or have their consent to do so. Do not upload recordings you have no right to share, and do not use the Service to record anyone covertly.

Invitations. If you invite someone, you confirm you have their agreement to provide their name and email address to us for that purpose.

5. Subscriptions, credits and payment

Free trial. New accounts get a 14-day free trial. No payment details are required to start.

Plans (in Australian dollars, including GST where applicable)

AI story credits. A subscription includes 5 AI stories per month. Extra stories are bought as credit packs. Credits are added to your account, are not transferable, have no cash value, and expire 12 months after purchase.

Renewal and cancellation. Subscriptions renew automatically at the end of each period until cancelled. You can cancel at any time from your account, or by contacting us. Cancelling stops future charges; you keep access until the end of the period you have already paid for. We do not charge a cancellation fee.

Payments are processed by Stripe. We never see or store your full card details. Failed or reversed payments may lead to suspension of paid features.

Price changes. We will give at least 30 days' notice before a price change affecting you, and you may cancel before it takes effect.

6. Refunds and consumer guarantees

Our Service comes with guarantees under the Australian Consumer Law that cannot be excluded. If the Service is not delivered with due care and skill, or is not fit for purpose, you are entitled to a remedy — which may be a refund.

Nothing in these terms excludes, restricts or modifies those rights. Outside of those rights, and to the extent permitted by law, fees already paid for a period are not refunded once that period has begun.

If a charge was made in error, or you were charged twice, contact us within 30 days and we will refund it. Apart from that, and apart from the rights described above, fees already paid for a period are not refunded once that period has begun.

7. Your content

You keep ownership of the recordings, story text and other content you create ("your content").

You give us a licence to store, copy, transmit, reformat and display your content, and to share it with the people you invite, only as needed to run the Service. This includes sending a recording to Yoto if you ask us to, and making it available through a private link to a reader you have invited. This licence ends when you delete your content or your account, except for copies in backups that expire on their normal schedule, and where we must keep records by law.

You are responsible for your content, and you confirm it does not infringe anyone else's rights, breach any law, and is not unlawful or harmful.

Our content and the library. Story text, artwork, characters, the app, and the public-domain retellings in our library belong to us or are licensed to us. You may use them inside the Service and send them to your own Yoto player, but you may not copy, resell, redistribute or republish them. Some library stories are AI-generated and are provided as-is (see §9).

8. Yoto

Yoto is a separate, third-party product. Your use of a Yoto player and Yoto's services is governed by Yoto's own terms and privacy policy. We are not responsible for Yoto, its availability, or its handling of your content, and we do not control which recordings Yoto retains on your device or account. Once a story is written to a physical Yoto card, it stays on that card — writing a new story over it may make the previous audio unrecoverable.

9. AI-generated content

AI stories are generated automatically from prompts. They may be inaccurate, unexpected, or below the standard of a human-written story, and they may vary between requests. Anthropomorphic animals, mild peril and fairy-tale endings are possible; we set style and length limits, but parents and carers should review a story before sharing it with a child. AI stories are not a substitute for your own judgement about what is appropriate for your child.

10. Acceptable use

Do not use the Service to:

child, or anything you do not have the right to share;

credit limits or paywalls;

We may suspend or end access if we reasonably believe you have broken these terms, or to protect other users, the Service, or a child.

11. Availability and changes

We aim to keep the Service available and reliable, but we do not promise uninterrupted or error-free operation. We may perform maintenance, change or remove features, or release features marked as beta or experimental. Where a change materially reduces what you get for a paid subscription, we will tell you and you may cancel with a refund of the unused portion.

12. Ending your account

You can delete your account at any time. We may suspend or end your access if you materially breach these terms, if we are required to by law, or if we stop offering the Service — in which case we will give reasonable notice and refund any prepaid amount for the period not used.

On deletion we remove your content from live systems (see the Privacy Policy for retention and backups).

13. Liability

To the extent permitted by law, and subject to §6:

not backed up elsewhere, or loss caused by a third party such as Yoto, Stripe or your internet provider; and

us in the 12 months before the event giving rise to the claim.

Nothing here limits liability that cannot lawfully be limited.

14. Governing law

These terms are governed by the laws of New South Wales, Australia, and the courts of that state have jurisdiction.
